BASIC CONCEPTS
Seller — Golenkova-Ferrero, owned by Irina Golenkova.
Offer — an offer to sell an item/items in accordance with the current Terms and Conditions of Sale.
Online boutique — an officially registered Internet selling platform in ownership of the Seller, located at golenkova-ferrero.com (hereinafter referred to as the Site). The Site is used as a selling platform for original designer home decor products of the brand Golenkova-Ferrero (hereinafter referred to as the Items).
User — an individual or legal entity visiting the Site.
Customer — either an individual that has placed an order on the Site by means of a credit card prepayment, via PayPal or Amazon Pay or a legal entity that successfully completed a bank transfer for an order. A customer can be both a registered and unregistered user.
Order — a duly executed Customer's request.
Buyer — a customer after his/her payment has been successfully acquired by a bank (credit card payment) or credited to the account of the Seller via bank transaction.
Terms of sale — detailed conditions for the sale of Items on the Site.
Recipient — a person indicated at the time of placing the order as the recipient of the Item/items.
Acceptance of the Offer — full and unconditional acceptance of the Offer by submitting the Order: filling in all the necessary data for the successful delivery of the order and clicking the "Order" button.
Purchase/Sale Agreement (hereinafter referred to as the Agreement) — a contract between the Seller and the Buyer, concluded by means of the Acceptance of these Terms and Conditions of Sale.
Parties — the Seller and the Buyer together.
Other terms used in this Offer are determined in accordance with the current legislation of Spain, the European Union as well as the settled business correspondence in the field of distance trade.
1. GENERAL PROVISIONS
1.1 These Terms and Conditions of Sale and all the information on the Site fully comply with the legislation of the European Union on e-commerce and consumer rights.
1.2 The Seller sells original copyrighted artisan items in her Online boutique.
1.3 The Acceptance of the Offer by the Customer is the momentum of ordering an Item/Items on the Site.
1.4 The Agreement between the Parties becomes valid as soon as the Seller receives the 100% pre-payment confirmation.
1.5 These Terms and Conditions of Sale is an open public document and is permanently located in the footer on the homepage of the Site. It may be unilaterally amended and/or supplemented by the Seller for subsequent orders. The text at the time of placing the Customer's Order remains in force for a current Order, whatever later changes on the Site.
1.6 The site contains materials protected by copyright and trademarks as well as other materials protected in accordance with the legislation of Spain and the European Union on intellectual property. Use of the Site content is allowed for personal non-commercial purposes only. Other uses, including the copying of the Site's individual elements, are absolutely prohibited. Violation of this provision entails liability in accordance with the current legislation of Spain and the European Union.
2. SUBJECT OF THE OFFER
2.1 The subject of this Offer is to enable the User to order the Item/Items, presented in the Online boutique, for his/her personal, family, home needs, other than resale.
2.2 This Offer applies to all types of Items displayed on the Site unless they get deleted from the Site directory.
3. REGISTRATION ON THE SITE
3.1 Registration on the Site is not mandatory for placing an order.
3.2 The User shall not tell any third party his/her login and password, specified while creating the account. As soon as the User has any suspicion regarding the security of his login and password or suspects any possibility of their unauthorized use by a third party, he/she shall immediately notify the Seller.
4. ORDER PLACEMENT
4.1 To purchase the Item/Items on the Site, the Buyer shall place the Order using the automatized Checkout and Payment interface on the Site.
4.2 The Seller ensures the timely production and delivery of the ordered Item/Items. In case of emergency situations (including pandemics, etc) the Seller informs the Customer on possible delays.
4.3 All accompanying photos of the Items on the Site are mockups of pre-order items or real samples and they may slightly differ from the actual appearance of the Items. Especially it concerns the shades, changing depending on the lighting, as well as differences in the colour depiction on different computer screens.
4.4 The Customer/Buyer bears full responsibility in case of errors in the submitted delivery address or telephone number/s, resulting in the Buyer's failure to properly perform his obligations to the Buyer.
4.5 After having successfully placed the Order on the Site, the Customer/Buyer is provided with more detailed information about the status of his/her Item/Items as well as the estimated delivery date by sending an electronic message to the address specified during the checkout.
5. PAYMENT OF ITEMS
5.1 The default currency of the Online boutique is EUR. The payment succeeds in EUR with automatic currency exchange by PayPal, Amazon Pay or the acquiring Bank.
5.2 The prices of the items on the Site may be unilaterally changed by the Seller. At the same time, the price for the already ordered Item/Items is not subject to change.
5.3 Payment for the Item/Items on the Site is carried out only by bank cards VISA or MasterCard, via PayPal or Amazon Pay. The credit card payment succeeds through entering one's card information into the E-commerce payment system, certified by Visa and MasterCard. The client data is fully protected with the certified 3D-Secure protocol and no one, including our online boutique, is in a position to access it. Rules of credit card payment:
5.3.1 In accordance with the legislation of Spain, all the operations with credit cards can be made only by a cardholder or by an officially authorized person.
5.3.2 Authorization of credit card transactions is carried out by the Bank. If the Bank has some reason to believe that the transaction is fraudulent, it is entitled to refuse to carry out this operation.
5.4 The Seller has the right to provide discounts on the Item/Items. Types of discounts are indicated on the corresponding Item or groups of Items and can be unilaterally changed by the Seller.
6. DELIVERY OF ORDERS
6.1 All the current delivery deadlines are indicated in the "SHOPPING GUIDE -> Shipping and Costs” section in the Footer of the Site.
6.2 The delivery cost is calculated automatically on the Site at the Checkout stage based on the recipient's zip code. The recipient does not make any further additional payments. But outside the EU, additional customs costs are sometimes possible, which depends exclusively on the customs regulations of a customer's home country. In the interest of the Parties, all monetary relationships between them are carried out exclusively in a secure non-cash way.
6.3 Delays in delivery are possible due to unforeseen circumstances that might occur unrelated to the Seller's actions. In this case, the Seller informs the Buyer and the latter has the right to cancel the Order and return his/her money.
6.4 As soon as successfully delivered to the delivery address, the Order is handed to the Recipient.
6.5 In order to avoid fraud, as well as to fulfil the obligations undertaken by the Seller, when delivering the Order, the courier has the right to request a document certifying the Recipient's identity.
6.6 The Seller's obligation to transfer the Items to the Buyer shall be deemed fulfilled when the Receiver accepts the Item/Items.
6.7 Taking the delivered package, the Recipient must check the package for its intactness. The signature in the delivery documents means that the Seller has fully and properly fulfilled his obligations towards the Buyer. The risk of accidental loss or accidental damage of the Item/Items is transferred to the Recipient as soon as he/she accepts the package with the Item/Items and signs the documents confirming the delivery of the Order.
6.8 All possible claims regarding the quality of the purchased Item/Items that might arise after the opening of the package are considered in accordance with the Law on the Consumer Rights of the European Union.
6.9 In case of non-delivery of the Order, the Seller refunds to the Buyer the full cost of the Item/Items soon after receiving from the Carrier an official confirmation of the loss of the Order or, if the Buyer wishes, resends the analogous Item/Items.

9.1 In case of any questions and complaints from the User/Customer/Buyer, the latter should contact the Seller by e-mail or What's App, indicating his contact number. All the disputes will be resolved by the parties through negotiations. Only if the agreement is impossible to reach, the dispute will be referred to the judicial authority in accordance with the current legislation of Spain and the European Union.
9.2. The court's recognition of the invalidity of any provision of this Offer does not entail the invalidity of the remaining provisions.
9.3 Online boutique might be temporarily unavailable due to technical maintenance issues or errors on the Site by the hosting provider beyond the Seller's control. The Seller shall take maximum efforts to minimize such cases.
